Suing 3 years after surgery?

A doctor saying something to you in private, and being willing to say it under oath in court are two different things. You are going to have to have all of your medical records professionally reviewed, possibly an MRI, and another surgeon's opinion supporting your allegation of negligence in order to have a decent med mal case. These things are generally done by a medical malpractice law firm when they take on a case.
